Terms of Use-GM Sanitary Industry Expo

Chapter 1 Overview

1.1This terms of use is formulated to promote new commercial culture of openness、transparency、sharing and responsibility, to build up a fair and open industrial online exhibition platform, to secure the legitimate rights of GM Expo users, to create and maintain a harmonious online platform environment.
1.2The terms apply to the use of GM Expo's any product or service (hereinafter referred to as "service").
1.3All users are equal in the application of the terms.
1.4All GM user should comply with international laws、administrative regulations、departmental rules and other regulatory documents, as well as signed agreements with GM Expo and its Terms of Use and Privacy Policy.
1.5When there is collision between the terms of use and the agreement which sighed by users with GM Expo, the signed agreement will be priority applied. For those aren't stipulated in the agreement, the terms of use will be applied. For those aren't stipulated in the terms of use, GM Expo has the right to deal with the issues on the merits of each case. But GM Expo's treatment behavior can't enable the users to be exempt from corresponding legal responsibility.

Chapter 2 Definition

2.1GM Expo: refers to General miracle online exhibition platform,

2.2Users: refer to the users who sign the GM Expo agreement and complete the process of registration as well as the verification. A member may have multiple accounts, each account corresponds to the only member name.
2.3Visitors: refer to the users who browse and save products as well exhibitors information、send inquiries to exhibitors, etc, on GM Expo.
2.4Exhibitors: refer to the users who complete the exhibitors verification、own an exhibition booth and display products on GM Expo.
2.5Complainants: refer to the natural persons、legal persons、enterprises and other economic organizations who initiate a complaint in conformity with the relevant laws and regulations.
2.6Defendants: refer to the GM Expo users who are subject to the complaints initiated by the complainants.
2.7Counter notice: refers to the notice and relevant certification materials submitted to GM Expo by defendants after being notified about the complaints.
2.8Unverified companies: refer to those companies which haven't passed the verification by GM Expo platform and in which using risk may exist.
2.9Verified companies: refer to those companies which have succeeded in the verification by GM Expo and confirmed to be trustable.
2.10Penalties: refer to that users will be punished due to violations of the Terms of use and other regulations. Punishment types include: warning、deletion、membership degrade、account restriction and account closure, etc.

Warning: GM Expo will warm the users about their violation behavior through phone calls、SMS and mails, etc. Users will be required to correct immediately, if not, further penalty will be practiced.

Deletion: GM Expo will delete the related illegal information, deleted information can't be retrieved by users.

Membership degrade: The product information displayed by the users will be ranked behind.

Account restriction: GM Expo will takes actions including, but not limited to the below: suspend the visiting access to the booth, put the displayed product off the shelf or remove the information (if applicable)、suspend users' permission to display product information, etc. Membership degraded users will need to pay the service cost as usual, and their membership period shall not be extended accordingly.

Account closure: GM Expo will terminate any service to the users, and service fee shall not be refunded.

Chapter 3 Overview

Section 1 Account registration

Account registration

3.1Users need to agree to and abide by the GM Expo Service Agreement when register as a member of the platform. Username (ID, also known as the member account or account)、company name or company website shall not con tain any related information which may violate the international laws、infringe others' rights or interfere with the normal orderly operation of GM Expo platform. One member can only register one account, and make sure that the verification mail address wasn't used in other accounts. Once the username is registered successfully, it can't be modified by user.

Account management

3.2User's account is prohibited to be transferred to other person or company without verification by GM Expo. User account will be closed if it's transfered without permission, furthermore, the user who transfers the account will be legally responsible for any activity under this account.
3.3GM Expo reserves the right to take back those inactive accounts which have below situations:
      (1) Company accounts which have not been verified by GM Expo.
      (2) Common user accounts which are not logged in to the platform in any forms in 6 months continuously.
      (3) There is no unexpired effective service under this account.
GM Expo has the right to close the user account in case of being involved with alleged fraud and other serious violations of the Terms of use and other related regulations. Meanwhile, GM has the right to delete all the information under these accounts. Users can apply for closure of their accounts by contacting with GM Expo service team.
3.4If the exhibitors don't pay for the booth after the free trial period, GM Expo will have the right to close relevant functions of the company account.

Section 2 Management

Information displaying/management

3.5Users should display product、information by following the principles of being legal、authentic、accurate、effective and complete. Users should comply with GM Expo regulations and be fully and independently responsible for the displayed information. Users are not allowed to display any information which violates Chinese laws、international laws and involves with alleged infringement of others' legal rights or interfere with the normal orderly operation of the platform, etc.

Chapter 4 Violation and treatment

Section 1 Definition of violation

4.1Violations refer to users' any behavior or activity which violates the regulations of GM Expo or any agreements between users and the platform.

Section 2 Types of violations

Display illegal/prohibited information

4.2It refers to that users display information which international laws and GM Expo platform prohibit or limit. In case of that displayed information is identified as those should be prohibited and limited, GM Expo will delete the information immediately. In addition, the user may be warned、account restricted or even account closed depending on the violation situation.

Information displaying/management

4.3It refers to that users display product information on GM platform in following inappropriate ways: use malicious external illegal software, use inappropriate product title or description、unreal characteristic、incorrect category placement、unreal product information、false pricing information, etc. In case of that the displayed product information is identified to be against the rules, GM Expo will put off the product information、delete the information and restrict the account, etc. based on the situation.

Infringement of intellectual property rights

4.4It refers to that the displayed information on the platform infringes upon others' intellectual property rights. Once the displayed information is complained about infringement, the user shall submit counter notice and proof material in time, to state the legality of the products. Users should ensure that the counter notice as well as the proof material is real、legitimate and effective. If no counter notice is submitted or the counter notice is not effective, GM Expo will put off the product information、delete the information and restrict the account, etc. based on the situation.

False product information

4.5It refers to that the displayed product information does not match the actual products. GM Expo will have the right to delete relevant false information, and give warning to the users via mails or phone calls, etc. For those users who repeatedly display false information, GM Expo has the right to punish them by restricting the account's right to display information or even closing the account, etc.

Abuse of user rights

4.6Abuse of user rights: it refers to that users use some programs to register GM Expo accounts in large quantities. The abusing activities include but not limited to sending spam mails、malicious inquiry、launch complaints or claims and other user rights, infringing others' legitimate rights and interfering with the orderly operation of the platform. For those users who abuse of user rights, GM Expo will take some control measurements such as warning、account restriction、account access limitation and service termination, etc.

Inappropriate propaganda

4.7It refers to that promotional contents which displayed by users are involved with improper use of others' right、disclosure of others' privacy、abuse of displaying information and other violated behaviors. Once the displayed product is identified to be propagated inappropriately, GM Expo will punish the users by deleting the product information、restricting the account' or even closing the account, etc.

Disturb the market order

4.8It refers to that users consciously circumvent GM Expo regulations and other market control measures in any ways, or obtain and use the resources、benefits and service of GM Expo and the third party by devious means. For those users who disturb the market order, GM Expo has the right to recover or cancel the related resources、benefits and service.

In default on the service fee to GM Expo

4.9In this case, GM Expo has the right to terminate part or full service given to the users. Furthermore, this breach of agreement may be published on the platform.

Section 3 Execution of violations punishment

4.10For those users who are involved with violations, GM Expo has the right to warn or punish them in accordance with relevant regulations.
4.11For those users who violate the regulations for the first time or have no subjective intention, GM Expo will correct and educate them depending on the situation, and require the users to do self-checking.

Section 4 Appeal against the violations punishment

4.12To appeal against the violation punishment, the defendants must submit relevant proof material in 5 working days from the date of issuing the complaint. If proof material is submitted late or the submitted proof material is not sufficient, GM Expo will have the right to make judgment and handle the case based on all the information and proof we had in hand.
4.13For those users who are confirmed to be involved with serious violations, the accounts won't be restored in spite of appeal.
